Kristin C. Cummings

Kristin represents many of the world’s largest property insurance companies in a wide range of complex first-party insurance matters across the United States. 

When COVID-19 presented an unprecedented threat to the insurance industry, Kristin was retained by several of her clients to serve as their National COVID Counsel to provide early and in-depth analysis on the novel coverage issues created by COVID-19 and litigate the disputed claims until final resolution.  Kristin is currently litigating COVID-19 claims in appellate courts throughout the United States, obtaining dismissals of those claims at the trial court level.

Kristin also has extensive experience in assisting clients on large commercial property claims arising out of natural disasters, including hurricanes, winter storms, wind and hailstorms, floods, and tornadoes, particularly those claims with challenging coverage issues and allegations of bad faith.

When possible, Kristin assists clients in resolving their most difficult disputes through a variety of methods, including providing early analysis of key issues, appraisal, and mediation. When disputes cannot be resolved, Kristin litigates those matters in state and federal courts nationwide.

Kristin also serves as the Hiring Partner for the Dallas office and on the firm’s Conflicts Committee.

Representative Matters

Litigated the first COVID-19 property damage claim in Delaware, resulting in the Supreme Court of Delaware’s affirmation of the order granting dismissal by the court below. (See APX Operating Company, LLC v. HDI Global Insurance Company (DE 2022)).

Currently represents multiple property insurers in ongoing appellate litigation arising out of COVID-19 across the United States, including courts in California, New Jersey, and New York.

Currently represents multiple property insurers in ongoing litigation with various Tribal Nations who brought for lost income claims from their casinos during the pandemic.

Currently represents a market of London Insurers in an arbitration regarding a multi-million-dollar builder’s risk project.

Currently represents clients in commercial hail and wind claims involving bad faith allegations in Texas, Louisiana, Oklahoma, Florida and Colorado.
