Hydrogen Peroxide Defendants Agree to Settle Indirect Purchaser Claims
June 10, 2010Defendants in the hydrogen peroxide indirect purchaser class action have agreed to settle for a total of $4.2 million, bringing the long-running multidistrict litigation over alleged price-fixing in the hydrogen peroxide industry closer to a conclusion. Plaintiffs filed a motion in the U.S. District Court for the Eastern District of Pennsylvania on June 9, 2010, reporting that defendants FMC Corp., Arkema Inc., Evonik Degussa GmbH, Akzo Nobel Inc., Kemira Chemicals Inc., Solvay SA and the latter three companies' affiliates agreed to end the litigation.
The plaintiffs alleged that the defendants violated antitrust laws of Arizona, California, Nebraska, Tennessee, and Vermont by engaging in a conspiracy to fix, raise, maintain and/or stabilize prices for hydrogen peroxide, sodium perborate and sodium percarbonate.
