James Robertson Martin Quoted in Reuters: Race is on to lead business interruption insurance litigation

James Robertson Martin, a partner in the Washington, DC office of Zelle, was quoted in a Reuters article titled “The race is on to lead business interruption insurance litigation.”

On Monday, April 20 at the Judicial Panel on Multidistrict Litigation, two motions were filed to consolidate federal suits accusing insurers of ducking claims by businesses that were shut down stemming from COVID-19 by government orders.

For the insurance industry, said Martin, a business interruption coverage MDL might someday make sense, but the recent requests seem premature at best. For example, it’s not clear that an MDL could include class actions – which are particularly ill-suited for business interruption claims.
