Dallas Court of Appeals Grants Special Appearance in Case in Which Zelle Represents Mexican Reinsurance Broker
August 24, 2017On August 22, 2017, the Dallas Court of Appeals issued a ruling granting a Special Appearance in a case in which the firm represents a Mexican reinsurance broker. In doing so, the Court of Appeals reversed the lower court’s exercise of specific jurisdiction.
Elamex SA de CV, a candy manufacturer, filed a pair of suits in Texas after its insurer denied coverage following a 2013 fire at one of its plants in Ciudad Juarez, Mexico. The Court of Appeals found that all of the activities involving Elamex, its insurer Seguros Afirme SA de CV, and its broker Cooper Gay Martinez del Rio & Asociados Intermediarios de Reaseguro SA de CV had occurred almost entirely in Mexico.
