Mallory D. Ball

Mallory’s legal practice focuses on insurance coverage, including providing insurers with advice on coverage-related issues and representing insurers in litigation. She has experience in a variety of insurance coverage matters, including bad faith and extra contractual actions against insurers in both first-party and third-party claims.

Prior to joining Zelle, Mallory represented insurers in various coverage matters, including direct-action litigation and workers’ compensation premium litigation. Mallory also has experience defending attorneys in legal malpractice actions, assisting attorneys in responding to bar complaints, defending insureds in liability actions, defending appliance manufacturers in products liability actions, and assisting veterans with discharge upgrades and appeals of denials of service-connected disability benefits.

Represented property carrier in bad faith action in connection with hurricane damage brought in federal court; won favorable summary judgment on late notice under Georgia law; affirmed on appeal

Represented property carrier in high-value insurance coverage litigation in connection with storm-related damage; won favorable motion to dismiss

Represented insurer in declaratory judgement action on insurance coverage issues arising out of the use of a four-wheeler in an undeveloped wooded area of a neighborhood

Represented insurer in declaratory judgment action on insurance coverage issues arising out of the death of a nursing home patient

Insurance Defense

Represented county conservator in connection with legal malpractice action brought in federal court; won favorable motion to dismiss based on res judicata

Represented attorney in connection with abusive litigation action brought in Georgia state court; won favorable motion to dismiss

Represented individual in connection with bodily injury claim brought in Georgia state court; won favorable motion to dismiss for failure to timely serve individual within the statute of limitations

Represented auto insurer in arbitration in connection with an uninsured motorist claim; award returned in favor of insured was significantly less than insurer’s final settlement offer
