Eric Retter
Eric Retter advises insurance carriers on a wide range of complex coverage matters and insurance-related disputes. He counsels clients in handling complex claims. Eric also counsels carriers regarding their rights and obligations under primary and excess policies in matters arising out of professional liability, cyber liability, commercial general liability, directors and officers liability, and business income insurance. Eric also represents insurers in litigation, including in declaratory judgment actions and matters involving allegations of bad faith and breach of contract, and he has extensive experience in state, federal, and appellate courts. Eric has also developed significant experience advising carriers on their rights and duties on TVPRA claims against their insureds.
Prior to joining private practice, Eric served as a law clerk to Chief Judge Federico A. Moreno of the U.S. District Court for the Southern District of Florida and as a staff attorney to Judge Aaron B. Mason of the State Court of Clayton County, Georgia.
Representative Matters
- Obtained summary judgment for insurer on claim for damage to commercial property on grounds that plaintiff had not presented sufficient evidence that damage arose out of covered event.
- Obtained summary judgment on behalf of insurer on all claims, including breach of contractual obligations, in matter arising out of alleged water loss.
- Obtained summary judgment in priority of coverage dispute between insurers in the United States District Court for the Northern District of Georgia arising out of a shooting that occurred at the premises of a mutual insured. The summary judgment was affirmed on appeal to the Eleventh Circuit.
- Won summary judgment in declaratory judgment action, achieving decision that insurer had no duty to defend or indemnify the insured for an incident that occurred on the insured’s premises.
