William Bornstein
Will represents and counsels clients in a variety of commercial litigation and business disputes. Will has represented both plaintiffs and defendants from many different industries in important and often high-stakes contract, statutory, and tort cases in courts throughout the country. Will has also represented large commercial clients in identifying, investigating, and bringing affirmative claims to recover losses caused by the misconduct of others. Most recently, Will’s efforts have focused largely on the healthcare industry, wherein he has helped health insurers pursue and obtain multi-million dollar recoveries against for-profit actors who have engaged in novel forms of unfair business practices and deceptive schemes, harming patients, legitimate businesses, and the healthcare system as a whole. Will has experience handling complex, high-value litigation from inception through resolution.
Representative Matters
Business Disputes and Commercial Litigation
Represented a health insurer asserting claims against national dialysis provider alleging that the provider deployed an unfair and deceptive scheme and conspired with a third party to induce vulnerable patients into commercial insurance plans. The case settled, and included $32 million in payments to the insurer.
Represented a family owned and operated broadcasting company in a contract dispute with a national satellite company. Sought temporary injunctive relief and obtained summary judgment in favor of the broadcasting company, which led to case resolution.
Represented a trust for a group of investors who suffered substantial losses in claims against a bank for its role in one of the largest Ponzi schemes in American history.
Represented a national distributor in a breach of contract arbitration against a national coffee company. The arbitration resulted in a $2.7 billion cash award to the distributor.
Represented a health insurer in defending against claims brought by laboratories asserting entitlement to unpaid patient medical benefits under ERISA, helping to get case dismissed on summary judgment.
Represented a Minnesota company in a breach of contract and warranty action against a manufacturer regarding the sale and failure to repair an allegedly defectively designed product.
Represented a health insurer in asserting fraud and related claims against laboratories, billing companies, and other entities and individuals for their role in allegedly submitting healthcare claims through the credentials of rural hospitals for lab testing the hospitals did not perform, and for engaging in fee splitting.

Pro Bono Activities
- Will has led efforts focused on helping veterans who have experienced PTSD and other forms of trauma while serving their country correct inaccuracies and unjust designations in their military records and obtain the recognition and benefits they deserve.
